Terms of Service
Effective date: May 1, 2026
These Terms of Service ("Terms") govern your access to and use of the Audiobook Forge service (the "Service") provided by Tiny Town Software ("Tiny Town", "we", "us", "our"). By creating an account or using the Service you agree to these Terms.
This document is plain-English by design and is not legal advice. If your jurisdiction requires specific disclosures, have a qualified attorney review it before relying on it.
The short version
- The price is per book and is shown before you check out. Use the free 30-second preview to confirm the voice, language, and tuning sound right.
- No refunds for "I changed my mind" or "I didn't like the voice." Each audiobook costs us real money in AI compute the moment you press "Buy & generate", and we can't get it back.
- Refunds are available if something is technically wrong on our end — corrupted file, missing chapters we promised, the wrong language synthesized, etc. Email us within 7 days.
- You own the rights to whatever you upload, and you only use the audio for personal listening unless we agree in writing otherwise.
- The Service is provided "as is" with no guarantees of uptime, perfect quality, or specific outcomes. AI narration is not a human narrator.
1. Eligibility
You must be at least 13 years old (16 in the European Economic Area) and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organization you represent that you have authority to bind that organization to these Terms.
2. Your account
You are responsible for safeguarding your sign-in credentials and for all activity that occurs under your account. Notify us immediately at security@tinytownsoftware.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that are used abusively.
3. The Service
The Service converts text documents you upload (EPUB, PDF, TXT) into narrated audio files using third-party AI text-to-speech engines, primarily Azure AI Speech. The output is a derivative audio work generated from your source material and the voice you select.
4. Your content and your rights
You retain all rights you have in the documents you upload. By uploading content you grant Tiny Town a limited, non-exclusive, worldwide, royalty-free license to host, copy, parse, transmit, and process that content solely as necessary to operate the Service for you (including by sending excerpts to our AI sub-processors for synthesis and content-safety screening). This license terminates when you delete the content or close your account, except for backups retained for the period needed to remove them.
You represent and warrant that you own or hold all rights necessary to upload each document and to have an audio derivative work generated from it for your own personal listening, and that doing so does not violate any applicable law or third-party right. You agree to the per-upload ownership/fair-use attestation we present at upload time.
You may listen to the generated audiobooks for personal, non-commercial use. Any commercial distribution, broadcast, public performance, or sale of generated audio requires a separate written license from Tiny Town and may also require additional licensing from Microsoft for the underlying voices.
5. Prohibited content and conduct
You will not upload, generate, or use the Service to produce:
- Content you do not own or have a clear license to use, including DRM-protected ebooks.
- Child sexual abuse material or any content that sexually exploits minors.
- Content that incites violence, terrorism, or illegal activity.
- Targeted harassment, defamation, or content designed to deceive (impersonation, voice cloning of real people without consent).
- Content that violates export controls or sanctions.
You will not (a) reverse-engineer or attempt to derive the source code or models behind the Service, (b) probe, scan, or test the vulnerability of any system or network, (c) abuse our preview, sign-in, or upload endpoints, or (d) use the Service to build a competing product.
6. Pricing and payment
Audiobook generation is billed per book. The price for a given book is calculated from the extracted character count and is shown to you before you check out. Payment is processed by Stripe. By placing an order you authorize the charge on the payment method you provide.
We may change pricing for future orders at any time; published prices apply to orders placed at that time. Sales tax, VAT, and other applicable taxes may be added at checkout.
7. Refunds
Audiobook generation runs on third-party AI compute that we are billed for per character the moment synthesis starts — whether or not you end up enjoying the result. Because we can't claw that cost back, our refund policy is narrow but clear:
You are eligible for a refund if any of the following happens:
- We fail to deliver an audiobook you paid for (synthesis errored out, the file is corrupted or unplayable, the file is missing chapters that should have been included, the wrong language or voice was synthesized vs. the one you selected, etc.).
- You were charged for an audiobook you did not order.
- A duplicate charge appears on your card for the same order.
You are not eligible for a refund if the audiobook delivered matches the options you chose at checkout but you no longer like the result. This includes, for example:
- You don't like how the voice sounds, the pacing, the pitch, or the style.
- The narration mispronounces certain words. AI text-to-speech is not perfect; this is why we offer per-document IPA pronunciation overrides on the upload page.
- You wanted a different chapter range, format, or bitrate than the one you selected.
- You decided after the fact that you'd rather have a human narrator.
We know this is stricter than a standard "30-day no-questions-asked" policy. We're a small operation and we genuinely lose money on a refunded order. To help you avoid that situation, we provide a free 30-second preview of any voice + tuning combination on every upload page — please use it before you press "Buy & generate" to confirm the voice, language, pace, and pitch sound the way you want. We also show your character count and chapter range right next to the Buy button so you can double-check what you're paying for.
Refund requests for technical issues should go to hello@tinytownsoftware.com within 7 days of delivery, with the order date and a description of what went wrong. We process approved refunds via the original payment method through Stripe.
8. AI-generated content disclosure
Audio produced by the Service is synthesized by AI text-to-speech engines and may contain mispronunciations, unnatural prosody, or other artifacts. The Service does not perform copyediting; we narrate the text we extract from your file as-is. You acknowledge that AI narration is not a substitute for a human narrator.
9. Intellectual property
The Service, including its software, design, and brand, is owned by Tiny Town Software and protected by intellectual-property law. These Terms do not grant you any rights to our trademarks or service marks. Voice models are owned by Microsoft and used under our agreement with Microsoft.
10. Third-party services
The Service integrates with third parties (Microsoft Azure, Stripe, our email provider). Your use of those services is subject to their own terms, and we are not responsible for their actions or outages.
11. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms, if your account is used abusively, or if we are required to do so by law. On termination your right to use the Service ends immediately; sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnity, governing law) survive termination.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT GENERATED AUDIO WILL MEET ANY PARTICULAR QUALITY STANDARD.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY TOWN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) AND (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You will indemnify and hold harmless Tiny Town and its affiliates from and against any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of or related to (a) content you upload or audio you generate, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual-property right.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. The exclusive venue for any dispute that is not subject to arbitration is the state and federal courts located in Delaware. You consent to personal jurisdiction there. (Adjust this clause to match your actual entity location and legal preferences.)
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email and/or an in-product notice at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
